Bérénice Ferrand is a Partner at Squair and a member of the Paris Bar. She also acts as an agent for artists and authors.

She advises professionals across the cultural and creative industries (including artists, authors, publishers, producers, labels, distributors, galleries, and art market players) on the protection, development, and enforcement of their intellectual property rights.

Her practice focuses on copyright law, trademark law, design law, and image rights, with particular experience in the music, audiovisual, publishing, live entertainment, and art market sectors.

Bérénice works as a legal partner to creative projects at every stage of their development, including:

  • Protecting creative works: securing copyright protection, filing trademarks and designs, and structuring ownership of rights;
  • Leveraging intellectual property assets: conducting IP portfolio audits and drafting and negotiating agreements (artist, publishing, distribution, executive production, merchandising, sponsorship, image rights licenses, and related contracts);
  • Enforcing intellectual property rights: handling infringement actions, unfair competition and parasitism claims, as well as violations of image rights and reputation.

She also advises clients on the legal challenges raised by the use of generative AI in the cultural and creative industries. Her work covers issues relating to the protection, exploitation, and ownership of AI-generated works, the safeguarding of existing catalogs used as training data, and the legal structuring of training models, in a rapidly evolving regulatory and case-law landscape.

Having trained and practiced in both Paris and Washington, D.C., Bérénice represents French and international clients, with a strong focus on cross-border intellectual property issues in the cultural sector.

Her approach is practical, engaged, and solution-oriented, with the goal of making intellectual property law clear, accessible, and effective for creators and cultural businesses.

In parallel with her legal practice, she teaches publishing law and cultural industries law at Sorbonne University, an academic role that closely informs her work and keeps her practice aligned with ongoing developments in the creative industries.
